1. About these terms

This website, zenzbl.com, is operated by ZENZBL, based in Sydney, New South Wales, Australia (“ZENZBL”, “we”, “us” or “our”). Contact: info@zenzbl.com.

These terms explain the permitted use of our website and the basis on which we receive enquiries. They do not replace a separately agreed proposal, confidentiality agreement, trial agreement or client contract. If a separate agreement conflicts with these terms on a project-specific matter, that agreement takes priority for that matter.

Our Privacy Policy explains how we handle personal information. Acknowledging that policy is not consent to unrelated marketing or a waiver of privacy rights.

2. Using the website

You may browse the website, share links and use the enquiry form for genuine enquiries. You must not:

  • use the website unlawfully or to infringe another person’s rights;
  • submit malicious code, spam, fraudulent content or deliberately misleading information;
  • attempt to gain unauthorised access to systems or other people’s information;
  • bypass security checks or overload or materially disrupt the website; or
  • reproduce or exploit our content commercially without permission, except as permitted by law.

We may restrict access where reasonably necessary to protect the website or address misuse. Restrictions will be proportionate to the circumstances and will not remove rights you have under applicable law or a separate agreement.

3. Sending information to ZENZBL

Please provide accurate contact details and only information reasonably needed to explain your enquiry. If you contact us for a business or another person, you must have authority to do so and to share the information provided.

Do not send passwords, API keys, payment-card details, identity documents, health records, production databases or other sensitive records through the general enquiry form. Describe the problem at a high level and use fictional or de-identified examples where possible. Contact us first if you need a secure transfer method or confidentiality agreement.

You retain ownership of your submitted content and any rights you hold in your data, branding and existing intellectual property. You authorise us to receive, store, copy and share your submission with the people and service providers reasonably needed to assess and respond to it, subject to our Privacy Policy and applicable law. This is limited permission for handling your enquiry; it does not transfer ownership or permit unrelated publication or commercial exploitation.

Submitting an enquiry does not itself create an NDA or client engagement. A separate NDA can define additional protections before you share detailed confidential material.

4. Enquiries and next steps

Sending an enquiry does not place an order, reserve development capacity, commit either party to a project or create a payment obligation. An automated submission confirmation confirms receipt by the website’s sending service; it is not acceptance of a project or a guarantee that a person has read the message.

We will consider genuine enquiries, but do not promise a particular response time or that every proposed project will be accepted. If your enquiry is time-sensitive, please make that clear and follow up by email.

5. Free prototypes and trials

Our free prototype and trial approach is available for suitable projects that we expressly agree to accept on that basis. Before starting, we agree the scope, evaluation arrangements, included revisions, trial duration, usage allowances, support, decision date and proposed purchase price.

There is no charge for the agreed free build and trial and no obligation to buy, including if agreed evaluation criteria are met. If you decline, there is no retrospective bill for that agreed free work and trial access ends. Additional work, extended use or costs outside agreed allowances require a separate agreement before being incurred on your behalf.

A trial may be a proof of concept or prototype and may require further work before production use. The written engagement terms will identify what is included, any remaining delivery work, ongoing costs and arrangements for returning or deleting your data.

Unless agreed otherwise in writing, ZENZBL retains ownership of software it creates during a free trial. If you purchase, the agreed project intellectual property, source code and handover transfer after full payment, subject to the agreed scope and existing or third-party rights and licences. Your own data, branding, confidential information and existing intellectual property remain yours.

6. Website information and product status

We take reasonable care with website information, but content may change and may contain errors or omissions. Contact us to confirm specifications, availability, suitability and proposed pricing before making a business decision. This clause does not excuse misleading statements or remove responsibility imposed by law.

Concept illustrations, renderings and products marked “In development” describe proposed work, not released functionality or verified performance. Trial availability does not mean a product is ready for every production environment. Product-specific commitments must be set out in the applicable agreement.

General website information is not tailored legal, financial, cybersecurity, clinical or other professional advice. Any specific advice or services we agree to provide will be governed by the relevant engagement.

7. Website content and third-party links

Website text, branding, images, designs and code belong to ZENZBL or the relevant rights holders. You may view the website and keep reasonable copies for personal use or internal evaluation. Other uses require permission unless allowed by law. Do not imply endorsement by ZENZBL or remove ownership notices.

Third-party names, marks and materials remain the property of their owners. Links to external websites are provided for convenience. Those websites have their own terms and privacy practices; we do not control their content or availability.

8. Availability and responsibility

We do not guarantee uninterrupted or error-free website access. We may perform maintenance or update, suspend or withdraw website features where reasonably necessary. This does not override commitments in a separate agreement.

Nothing in these terms excludes, restricts or modifies any right, guarantee, remedy or liability that cannot lawfully be excluded, including under the Australian Consumer Law. Where a statutory guarantee or remedy applies, it continues to apply.

Subject to those protections, we do not give additional promises about the website’s continuous availability or its suitability for a particular purpose. Responsibility for any loss is determined under applicable law and any relevant separate agreement. These terms do not impose a blanket indemnity on visitors or exclude liability for our fraud or wilful misconduct.

9. Changes to these terms

We may revise these terms and publish the updated version with a new effective date. Changes apply prospectively and do not retrospectively change an accepted engagement, agreed free trial or rights that have already arisen. Material changes to a separate agreement require the process specified in that agreement.

10. Questions, disputes and governing law

Please contact info@zenzbl.com first so we can try to resolve a concern. This does not prevent you from seeking urgent relief or contacting a regulator, tribunal or court.

These terms are governed by the laws of New South Wales, Australia. The courts of New South Wales have non-exclusive jurisdiction, subject to any mandatory rights you have to bring a claim elsewhere. If a provision is unenforceable, it is severed only to the extent necessary and the remaining provisions continue to operate.
